Conservation of Agricultural Resources Act
43/1983

The conservation of soil, water resources and vegetation is promoted. Management plans to eradicate weeds and invader plants must be established to benefit the integrity of indigenous life.

The provisions of this Act relating to both weeds and invader plants, must not apply to any land to be a mountain catchment area under the Mountain Catchment Areas Act (63 of 1970).

6. Control measures

Control measures must be complied with by land users. The control measures relating to water include:

        the irrigation of land
        the prevention of or control of water logging or salination of land
        the regulating of the flow pattern of run-off water
        the protection of water resources against pollution because of farming practices.

8. Schemes

A scheme may be established in terms of which assistance such as subsidies may be granted to land users. The payment of subsidies must be in respect of the following water related activities:

        the reparation of damage to the natural agricultural resources or soil conservation works which has been caused by a flood or any disaster caused by natural forces
        the restoration of the eroded, disturbed, denuded or damaged land
        the planting and cultivation of particular crops that improve soil fertility or counteract the vulnerability of soil to erosion.

11. Minister may perform certain acts

Upon agreement with the owner of the land, the Minister must perform any act, for the purpose of public demonstration or for research in any matter relating to veld, soil or water conservation

18. Powers of investigation

Several peoples, such as officers of the department and members of a soil conservation committee are authorised to enter upon any land in order to determine whether and to what extent the water sources on that land are polluted because of farming methods.
(S)he must also make surveys, like taking soil or plant samples in order to assess the condition of soil, water sources and vegetation .
