Water use includes the taking and storing of water, activities which reduce stream flow, waste discharges and disposals, controlled activities which impact detrimentally on a water resource, altering a watercourse, removing underground water for certain purposes and recreation. In general, water use must be licensed unless it is listed in Schedule 1, is an existing lawful use, is permissible under a general authorization, or if a responsible authority waives the need for a license.

Permissible water use (22(1)) must comply with any applicable waste standards or management practices prescribed under section 26(1)(h) and (i) in the case of the discharge or disposal of waste or water containing waste contemplated in S 21 (f), (g), (h) or (j)

Regarding regulations on the use of water (26), the following considerations have to be taken into account:
    Promoting the economic and sustainable use of water
    Conserving and protecting of water resources, instream and riparian habitat
    Preventing of wasteful water use
    Facilitating the management of water use and waterworks
